1. Introduction
Welcome to BroFoam Experts. These Terms and Conditions govern your use of our website, communications, estimates, and insulation services.
By accessing our website, submitting a service request, requesting an estimate, scheduling work, or otherwise engaging with BroFoam Experts, you agree to these Terms and Conditions.
Please review them carefully before using our services.
2. Services Provided
BroFoam Experts provides professional insulation solutions for residential and commercial properties. Our services may include open cell spray foam insulation, closed cell spray foam insulation, fiberglass insulation, Rockwool insulation, blown in insulation, and other insulation services that may be offered from time to time.
The exact scope of work for each project will be based on the estimate, proposal, contract, or other written agreement provided for that project.
3. Website Use
By using our website, you agree to use it only for lawful purposes and to provide accurate information when submitting forms or service requests. You may not attempt to damage, disable, interfere with, or gain unauthorized access to the website or related systems.
You may not copy, misuse, reproduce, or distribute website content without permission, and you may not use the website in a way that infringes the rights of BroFoam Experts or others.
We may modify, suspend, or discontinue portions of the website at any time.
4. Estimates, Pricing, and Payment
BroFoam Experts may provide estimates based on the information available at the time of inspection or consultation.
Final pricing may depend on project size, insulation material selected, required insulation thickness, accessibility, existing conditions, preparation requirements, material costs, or changes requested after the original estimate.
Customers are responsible for paying all amounts according to the payment schedule stated in their estimate, proposal, invoice, or service agreement.
Failure to make required payments may result in delayed work, suspension of services, cancellation, collection activity, or other remedies permitted by law or contract.
Any billing concerns should be reported to BroFoam Experts promptly after receiving the applicable invoice.
5. Appointments and Scheduling
Appointments and installation dates are subject to availability.
BroFoam Experts may need to reschedule or delay work because of severe weather, unsafe jobsite conditions, material availability, equipment problems, employee illness, access issues, unexpected building conditions, or other events outside our reasonable control.
Customers are responsible for providing accurate contact information and ensuring that authorized access to the property is available at the agreed time.
6. Customer Responsibilities
Before work begins, customers are responsible for helping provide a safe and accessible work environment.
This includes providing clear access to the installation area, moving valuables, furniture, stored items, or fragile property away from the work zone when requested, keeping children, pets, and unauthorized individuals away from active work areas, and informing BroFoam Experts about known hazards or unusual conditions.
Customers should also disclose known moisture issues, mold, asbestos, structural damage, electrical hazards, or other conditions that could affect the work and provide accurate information about the property and requested project.
BroFoam Experts is not responsible for damage caused by undisclosed conditions, inaccessible areas, pre existing defects, or customer property that was not moved or protected as requested.
7. Changes to the Scope of Work
The project scope will be based on the approved estimate, proposal, or service agreement.
If additional work, unexpected conditions, or customer requested changes arise after work begins, BroFoam Experts may provide revised pricing or a change order before completing the additional work.
Work outside the agreed scope may require additional charges and additional time.
8. Hazardous and Unforeseen Conditions
BroFoam Experts does not provide hazardous material remediation unless specifically agreed to in writing.
If mold, asbestos, structural instability, unsafe wiring, water damage, pests, contamination, or another hazardous condition is discovered, work may be stopped until the issue is properly addressed.
Additional inspection, remediation, repair, or preparation may be required before insulation work can continue.
BroFoam Experts may recommend that the customer contact an appropriately qualified specialist when necessary.
9. Limitation of Liability
To the fullest extent permitted by applicable law, BroFoam Experts will not be responsible for indirect, incidental, special, exemplary, or consequential losses arising from use of the website or performance of services.
Nothing in these Terms is intended to exclude liability that cannot legally be excluded under applicable law.
BroFoam Experts is not responsible for losses caused by pre existing building conditions, hidden defects, inaccurate or incomplete customer supplied information, work performed by other contractors or property owners, events outside our reasonable control, or changes to the property after our work has been completed.
Any project specific limitations or remedies stated in a signed agreement will also apply.
10. Warranties
Any warranty provided by BroFoam Experts will be governed by the written warranty terms, estimate, proposal, manufacturer documentation, or service agreement applicable to the project.
Warranty coverage may vary depending on the insulation product, installation type, manufacturer requirements, and project conditions.
Warranty coverage may not apply to problems caused by water intrusion, structural movement, alterations after installation, damage by another contractor, improper maintenance, pest activity, fire, natural disasters, or conditions outside the installed insulation system.
Customers should review any written warranty documentation provided for their project.
11. No Guarantee of Specific Energy Savings
Insulation can help improve thermal performance and may reduce unwanted heat transfer or air movement when properly designed and installed.
However, BroFoam Experts does not guarantee a specific reduction in utility bills or energy consumption.
Actual results can vary based on building construction, HVAC equipment, existing insulation, windows and doors, air leakage, weather conditions, occupancy, thermostat settings, and energy use habits.
Any energy efficiency descriptions are general performance information and should not be interpreted as a guaranteed financial result.
12. Cancellations and Refunds
Customers should provide reasonable notice when cancelling or rescheduling an appointment.
Refund eligibility depends on the circumstances of the project and may be affected by work already completed, labor already performed, materials already ordered, custom or non returnable materials, deposits, administrative or preparation costs, and terms included in the customer's signed agreement.
Project specific cancellation terms stated in a proposal or contract will control if they differ from this general policy.
13. Force Majeure
BroFoam Experts will not be responsible for delays or failure to perform caused by events reasonably outside our control.
These may include severe weather, natural disasters, utility failures, government actions, labor shortages, supply shortages, transportation disruptions, emergencies, pandemics, equipment failures, or similar events.
When possible, we will communicate with affected customers and reschedule work within a reasonable timeframe.

The Privacy Policy explains the types of information we may collect, how we may use it, and the choices available to users regarding their information.
16. Dispute Resolution
If a dispute arises relating to our services, both parties are encouraged to first attempt to resolve the matter directly and in good faith.
Where appropriate and mutually agreed, the parties may attempt mediation before pursuing formal legal proceedings.
Nothing in this section prevents either party from exercising rights or remedies that cannot lawfully be waived.
17. Governing Law
These Terms and Conditions are governed by the laws of the State of Michigan, without regard to conflict of law principles.
Any legal proceeding arising from these Terms or our services will be handled in a court with proper jurisdiction in Michigan unless another venue is required by applicable law or a separate written agreement.
18. Changes to These Terms
BroFoam Experts may update these Terms and Conditions from time to time.
Any revised terms will be posted on our website with an updated effective date. Continued use of the website after changes are posted constitutes acceptance of the revised website terms to the extent permitted by law.
Project specific agreements already signed by customers will remain subject to their own terms unless amended by agreement.
